PRESENT: Mayor Fixell, presiding; Trustees Butler, Hoyt, McGee, McGovern, and Zollo; Village Administrator McCabe; Village Treasurer Hart; Chief of Police Brown; Recreation Supervisor Arduino; Village Attorney Shumejda; and Village Clerk Booth
ABSENT: Trustee Basher
The meeting began with the Pledge to the Flag.
PRESENTATION OF A CERTIFICATE OF MERIT TO MELISSA MELENDEZ, BOYS AND GIRLS CLUB OF NORTHERN WESTCHESTER YOUTH OF THE YEAR
Now therefore be it resolved that I, Drew Fixell, Mayor of Tarrytown, New York,
congratulate and commend Melissa Melendez of Sleepy Hollow High School
for your achievement in gaining high recognition as the 2007 Youth of the Year
Boys and Girls Club of Northern Westchester and declare you a Student of Excellence.
RECOGNITION OF AWARDS RECEIVED BY POLICE OFFICER DAVID KAPICA AND POLICE OFFICER ANDREW JONES FROM THE NEW YORK STATE STOP-DWI PROGRAM
Mayor Fixell presented the awards and stated that each year the Mid-Hudson Valley Region of the New York State STOP-DWI Program hosts an Enforcement/Prosecution Training Conference. As part of that conference officers are recognized for their efforts in enforcing laws pertaining to DWI during the period of time from October 1, 2005 through September 30, 2006. They are referred to as TOP COPS and are awarded plaques for their efforts. The department nominated Police Officer David Kapica and Police Officer Andrew Jones for these awards which were bestowed upon them by the County of Westchester STOP-DWI program on April 5, 2007 during the conference. Police Officer Kapica received 1st Place award for his diligent efforts by arresting 15 persons for DWI related charges and Police Officer Jones
received a 2nd Place award for his diligent efforts by arresting 13 persons for DWI related charges. These officers work within the regular patrol division and are assigned the daily tasks as are all other officers; however, they have made an extra effort beyond that by aggressively seeking these violators during their non committed patrol time. They should be congratulated for their fine efforts.
REPORTS
Mayor Fixell reported on the following:
- A reminder that Monday, May 28th, A Memorial Day Parade will begin on Main Street at 9:00 a.m. and then immediately following a memorial service will be held at Patriots Park. Following that will be our Family Fun Day at Patriots Park. Hopefully you will come out and have an enjoyable day.
- The Little Gardens of Tarrytown is holding its 2007 House and Garden Tours on Saturday, June 9th. Check in is at the Historical Society of Tarrytown and for more information, call 715-4687 or 589-3380.
Trustee Zollo reported on the following:
- On Thursday of last week there was a major fire in Sleepy Hollow on Beekman Avenue. The Sleepy Hollow Fire Department took the lead in managing and fighting the fire, but the Tarrytown Fire Department played a significant role known as a “good stop.” The Fire Department did a great job and my compliments to them.
- Yesterday, several members of the Tarrytown Fire Department were invited down to the Hudson River by the young man who jumped off the Tappan Zee Bridge on Easter Sunday, who was saved by members of the Tarrytown Fire Department. He along with his father met the members and wanted to thank them personally for saving his life. He gave each of the members an engraved memento just as a reminder of their heroic act.
- The Beautification Committee is currently planting flowers on Broadway and Main Street. While you enjoy the beauty, please keep cigarette buts out of the tree wells. His compliments to the Beautification Committee for a job well done for dressing up the inner village.

OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: SPEAKERS HAVE 5 MINUTES BEFORE YIELDING TO THE NEXT PERSON: THEN 3 MINUTES FOR ADDITONAL COMMENTS
Victor Arpi, Franklin Courts, asked the Board what the status of the permanent roof lights on taxicabs. Police Chief Brown stated that an owner of the Ameritas Taxi came up with an alternative method where you can attach the light to the roof through the rails of the rain gutters and you don’t have to put holes in the car. The equipment for this can be purchased at Home Depot for $10.00. Chief Brown stated that this alternative is acceptable with the Tarrytown Police Department.
Felix Lantigua, resident of Sleepy Hollow, stated that the magnetic lights have worked well. He doesn’t see why he should put a hole in his car for a permanent roof light. Police Chief Brown stated that it’s the code of the Village of Tarrytown. The Village feels that the safety of our residents is incumbent upon having cars readily recognizable. Chief Brown also stated that if Mr. Lantigua has another alternative, excluding magnetic, to please stop by the Police Department and share his ideas.
THE MAYOR’S APPOINTMENT OF AN ALTERNATE MEMBER OF THE PLANNING BOARD
Trustee Zollo moved, seconded by Trustee Butler, and unanimously carried that the following be approved: Approved: 6-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the Mayor’s appointment of Frank Demers, former member of the Planning Board, as an alternate member of the Planning Board.
THE MAYOR’S RE-APPOINTMENT OF THE CHAIRPERSON OF THE PLANNING BOARD
Trustee Hoyt moved, seconded by Trustee McGovern, and unanimously carried that the following be approved: Approved: 6-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the Mayor’s re-appointment of Stanley Friedlander as chairperson of the Planning Board for a term to expire April 2008.
CONSIDERATION OF A STUDY FOR A HABITAT AND BIODIVERSITY ASSESSMENT OF THE PROPOSED LEGENDS AT WILSON PARK DEVELOPMENT SITE
Trustee Hoyt moved, seconded by Trustee McGovern, that the following be approved.
Motion carried, all voting “aye” with exception of Trustee Butler who abstained and Trustee Zollo voted “aye” with reservation. Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes the Mayor to sign a proposal with Hudsonia, Ltd. for not more than $4,500 to provide a habitat and biodiversity assessment of the proposed Legends at Wilson Park development site and near vicinity in the Village of Tarrytown at the request of the Planning Board.
APPOINTMENT OF A PART-TIME SEASONAL LABORER
Trustee Zollo moved, seconded by Trustee Butler, that the following be approved.
Motion carried, all voting “aye.” Trustee Hoyt voted “aye” with reservation. Approved: 6-0
Be it resolved that the Board of Trustees of the Village of Tarrytown hereby appoints Tim Arduino, 44 Leroy Avenue, to the part-time seasonal position of Laborer in the Parks and Recreation Department at an hourly rate of $9.00 effective May 14, 2007 through August 31, 2007.

Trustee Zollo moved, seconded by Trustee Butler, that the following be approved.
Motion carried, all voting “aye.” Trustee Hoyt voted “aye” with reservation. Approved: 6-0
Be it resolved that the Board of Trustees of the Village of Tarrytown hereby appoints James Yancy Jr., 3C Franklin Court, to the part-time seasonal position of Laborer in the Parks and Recreation Department at an hourly rate of $9.00 effective May 14, 2007 through September 28, 2007.

Be it resolved that the Board of Trustees of the Village of Tarrytown hereby appoints Frank Giampiccolo, Jr. to the part-time seasonal position of Laborer in the Department of Public Works at an hourly rate of $9.00 effective June 4, 2007 through August 31, 2007.
APPOINTMENT OF A PART-TIME SEASONAL LABORER
Trustee Zollo moved, seconded by Trustee Butler, that the following be approved.

Be it resolved that the Board of Trustees of the Village of Tarrytown hereby appoints Joseph Heymann (3rd year with DPW) to the part-time seasonal position of Laborer in the Department of Public Works at an hourly rate of $9.50 effective June 4, 2007 through August 31, 2007.
APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON MAY 7, 2007
Trustee McGee moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular board meeting held on May 7, 2007 as submitted by the Village Clerk.
APPROVAL OF AUDITED VOUCHERS #21
Trustee Hoyt moved, seconded by Trustee Zollo, and unanimously carried that the following resolution be approved:
RESOLVED: The following Abstract bearing No. 21, dated May 21, 2007 containing Vouchers No. 004220 through No. 004384 is hereby ordered paid in the
following amounts as presented:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 004339, 004345, and 004346, , and Trustee Hoyt who abstained from Voucher Number 004354, 004355, and 004362. Motion carried

ADJOURNMENT TO EXECUTIVE SESSION
Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried, that the meeting be adjourned to Executive Session to discuss personnel matter at 8:45 p.m.
